The Skills in Demand (subclass 482) visa is for Skilled temporary workers who are sponsored by their employer.

Under the SID visa program, employers can sponsor an overseas candidate to work in a range of skilled positions for up to 4 years.

Process Overview

There are three applications involved in obtaining a SID visa:

Business Sponsorship or Labour agreement application – the Employer applies for business sponsorship or labour agreement status. This allows them to sponsor positions and is valid for 5 years. The business can be an established entity in Australia, a start up business or an overseas business setting up operations in Australia.

Nomination application – The Employer nominates the position to be filled by the visa applicant. The position must meet the regulatory requirements such as the labour market testing criteria, annual market salary rate.

There are three streams available to employers:

  • Core Skills Stream – this is for roles where the salary is less than the Specialist Skills Income Threshold. The nominated occupation must be on the Core Skills Occupation List. They must mee the Core Skills Income Threshold, currently $76,515.
  • Specialist Skills Stream – this is for roles which meet the Specialist Skills Income Threshold (currently $141,210). Any occupation in Major Groups the ANZSCO 1,2,4,5 or 6 can be nominated in this Stream.
  • Labour Agreement Stream – this is for roles where the business has obtained a labour agreement. The requirements are governed by the terms in the labour agreement.

Visa application – The visa applicant applies for the visa. They can include family members in their application. The applicant must meet the skills requirements as well as health, character and English criteria.

Business sponsors are subject to a number of sponsorship obligations which are monitored by the Department of Immigration.
