What are the visa options?
- Employer Nomination Scheme (subclass 186) – for most employers
- Regional Sponsored Migration Scheme (Subclass 187) – for employers in regional areas.
For the Subclass 186 visa, there are three pathways which an employer can use to sponsor an applicant for permanent residency :
- Temporary Residence Transition Scheme (TRTS) – for 482 visa holders who held a 482 visa for at least 2 out of the last 3 years.
- Direct Entry Stream (DES) – for individuals who do not meet the TRTS requirements or are applying from overseas. They must obtain a positive skills assessment and evidence 3 years of full-time (equivalent) employment.
- Labour Agreement – for employers who enter a special agreement with the Department of Immigration and the Department of Employment.
Labour agreement applications are relatively rare given the restrictions applicable to obtaining this agreement.
For the 187 visa, only the TRTS stream is still available for transitional subclass 457 or subclass 482 workers.
What do these visa let me do?
Once granted, the visa allows the holder to remain in Australia indefinitely, however, they must apply for a Resident Return visa to travel to Australia every 5 years.
There is no work restriction on each visa, however, there is a cancellation power on the 187 visa whereby the visa could be cancelled if the visa holder has not commenced work within 6 months or the employment is terminated within 2 years of the visa grant.
